Gilat Satellite Networks Ltd. and its subsidiaries and affiliates (collectively “Gilat”, “we”, “us” “our”) is committed to protecting the privacy of any Data Subject who shares with us Personal Information, including those who visits our website at https://www.gilat.com/ (the “Website”). This privacy notice (this “Notice“) outlines how we use and process Personal Information, the purposes for which we use it, who we share it with, and the steps Gilat is taking to protect privacy and the limitations in doing so.

In this Notice, the following terms shall have the meaning ascribed next to them. Some definitions may vary slightly depending on the Applicable Law, but the core principle remains. In the event of a conflict between the definition under Applicable Law and the definition herein, the definition under Applicable Law shall prevail.

1.2 “CCPA” means California Consumer Privacy Act of 2018, as updated and/or amended from time to time, including by the California Privacy Rights Act of 2020 (“CPRA”).
1.3 “Data Subject” or “you” means any individual whose Personal Information is processed by the Company in or through the Website, or through other channels.
1.4 “GDPR” means General Data Protection Regulation (2016/679), as updated and/or amended from time to time
1.5 “Personal Information” means any information that identifies, refers to, describes or could reasonably be linked, directly or indirectly, to an individual.
1.6 “Processing” means any activity or set of operation that we do with your Personal Information (whether you provide us through the Website or via other channels of communications, or that we collect from you through technological tools), including (without limitations) collection, storage, use, disclosure.

If you apply for a job through other channels (e.g. via job boards platforms, or through an employee who works for us), you may provide us, directly or indirectly, and we may learn additional Personal Information about you during the recruitment process itself, as it progress (e.g., from placement testing centers, recruitment consultants, reference checks, background checks results, etc.).

You are hereby informed that in some jurisdictions, the provision of such sensitive Personal Information is required by law, and it is mandatory to evaluate your suitability for the position. |

2.2 In addition to the above usage of your Personal Information, we may also Process your Personal Information for the following purposes:
a. To ensure the security of the Website, and to prevent and detect illegal or unauthorized activities on the Website.
b. Comply with applicable law, dispute resolution, respond to legal processes, pursue legal rights, defend litigation, or comply with requests of government or public authorities, to enforce this Notice;
c. For any other lawful purpose.
2.3 For Data Subject in California, it is hereby clarified under the CCPA and CPRA, that we DO NOT SELL OR SHAREyour Personal Information with third parties for monetary or other valuable considerations. We do not use Personal Information for cross-context behavioral advertising or profiling without your consent.
2.4 For Data Subject who are job applicants:
2.4.1 Sensitive Personal Information will be collected only when it is permissible under Applicable Law and/or when you decide to share such sensitive Personal Information, and only if it is relevant to the recruitment process or the specific role for which you are applying. Where required by Applicable Law, we will obtain your consent prior to such collection or Processing, without derogating from your rights to limit the use of such sensitive Personal Information, under Applicable Law.
2.4.2 Some Personal Information (including sensitive Personal Information) may be collected and processed as part of conditional steps in the recruitment process. These activities (such as background checks, verification of references etc.) are intended to confirm your suitability for the role and compliance with legal or organizational requirements. The outcome of such checks may influence the final hiring decision.
2.5 For Data Subject who are contact person of a customer, note that when you login to your account, or after you create an account, you leave the Website and enter into Gilat’s Customer Service Portal.
2.6 We may process some Personal Information from Data Subject who visit our premises, based on local privacy notices that will be shared with such Data Subject at the entrance to our premises.
2.7 Except as specifically provided in the Notice (and/or in local privacy notices for visitors), Data Subjects are not legally compelled to provide Gilat with any Personal Information, and the provisions of such Personal Information are based on their free will. However, failure to provide us with such Personal Information may prevent you from contacting us for the purpose you intended – for example, to receive a service through the Website or receive a response on various matters, to subscribe to our newsletter or receiving marketing materials, apply for a specific position, etc. It may also prevent us from rendering you the requested service, or from responding to you question/query, and you hereby waive any claim or demand against Gilat in this regard.
3. Legal Basis for Processing
We will only process your Personal Information where we have a legal basis to do so (where applicable). The legal basis will depend on the purpose(s) that we use your Personal Information, and on Applicable Law in your jurisdiction. In most cases, the lawful bases we rely on for processing your Personal Information, are as follows:
3.1 Consent: You gave us your informed or explicit consent to process your Personal Information for one or more specific purposes. In territories governed by privacy laws where “Consent” is the only (or at least the main) legal basis for Processing your Personal Information, browsing our Website and/or providing us with Personal Information to apply for a job or contact us is deemed to constitute your informed consent to the processing of your Personal Information for all relevant purposes outlined in this Notice;

3.3 Legal obligation: Processing is necessary for compliance with a legal obligation which Gilat is subject to;
3.4 Legitimate interests: Processing is necessary for the purposes of the legitimate interests pursued by Gilat as a Controller, or by a third party.
4. Data Sharing and Cross Border Transfer
To pursue the purposes of processing as listed above, we may share your Personal Information with third parties in the following ways:
4.1 We may disclose your Personal Information internally within Gilat group (i.e. With Gilat Satellite Networks Ltd. and its subsidiaries and affiliates), if applicable to the reason you approached us, or in case any entity within the Gilat’s group undergo any change of control or ownership (including in case of merger, acquisition, etc.).
4.2 We may share your Personal Information with our service providers, contractors, and consultants (such as IT, software and network service providers, our legal, financial and our compliance advisors, and (where applicable) with assessment and placement agencies and recruitment analytics. Our service providers are required to maintain confidentiality and applicable data protection laws.
4.3 With respect to Data Subject that apply for a job, in some cases (as specified in this Notice), we may share Personal Information with our customers, if the position you apply for requires so and subject to Applicable Law.
4.4 We may disclose your Personal Information to judicial, government and regulatory authorities, (a) to comply with applicable law, regulations, rules, requests for law enforcement or other legal proceeding; (b) if it is required to protect our legitimate business interest; or (c) if it is required to enforce the T&C on our Website, or this Notice.
By browsing our Website and/or providing us with Personal Information (through the Website or via other channels, as mentioned above), you acknowledge and consent that for the purposes set forth above, we may transfer your Personal Information to countries outside your jurisdiction, including to countries that may not offer the same level of data protection that applies in your jurisdiction. However, we use appropriate safeguards, that may vary – depending on the Applicable Law that apply to us in each relevant jurisdiction, in order to ensure that your Personal Information is protected during such cross-border transfer.
5. Data Retention
We retain Personal Information for as long as necessary to fulfill the purposes for which it was collected, including to comply with legal, regulatory, and contractual obligations.
If you are a job applicant and your application for employment is successful, your Personal Information will be transferred to your personnel file consistent with our employee Privacy Notice which you will receive at the time of concluding your employment agreement. If your application is unsuccessful, we would like to store your Personal Information for a period of 30 months to allow us to contact you should future vacancies arise. After this period of time all Personal Information will be removed from our systems. If you wish to exercise your rights regarding your Personal Information, please contact us and we will following the requirements under Applicable Law.
6. Data Subject Rights
You may have certain rights in relation to your Personal Information and in most cases, you can exercise them free of charge. Such rights may differ, depending on your jurisdiction and the Applicable Laws, so they may not be available to all Data Subjects in the same way.

6.1 Right to be informed: You have the right to know what Personal Information is collected about you, the purpose of its use, and who may receive it.

6.4 Right to deletion: subject to the exemptions pecified in the Applicable Laws, you may request deletion of your Personal Information if it is inaccurate, incomplete, unclear or outdated, if it is when it is no longer necessary for the purpose if was collected for, or if it was collected unlawfully.
6.5 Right to object or restrict certain tryps of processing, including profiling (such as for direct marketing purposes) or opt out (for example – from decision made solely by automated processing, targeted advertising, etc.). In some jurisdictions you may have the right to limit the use of sensitive Personal Information (if collected).
6.6 Right to withdraw consent: Where processing is based on your consent, you may withdraw it at any time.
6.7 Right to lodge a complaint with the applicable supervisory authority, if you believe your data rights have been violated, or to appeal If we deny your request.
Gilat and its subsidiaries and affiliates operate globally, and therefore we are subject to a variety of Applicable Laws, each with its own sets of rules and rights. Since it is not practical to list every possible right in this Notice, the above sets a non-exhaustive list of kinds of rights you may have. Nonetheless, no matter where you are located, we are commited to respecting and fulfilling all rights granted to you under Applicable Laws. You can contact us (according to the details set forth below) at any time if you wish to exercise your rights, and we will respond to your requests in the timeframe prescribed by the relevant Applicable Laws.
7. Cookies
We may use several types of Cookies or other similar technologies in our Website. “Cookies” are small data files sent to your browser and stored on your device while your are browsing out Website. Cookies may help websites, among others, remember preferences, improve functionality, and deliver relevant content. Cookies may collect certain data which, under some Applicable Law, may be considered as Personal Information, as mentioned in section 2.1 above. 8. Security Measures
We have implemented security and organizational safeguards that aim to protect your Personal Informational from unauthorized access, disclosure, alteration or destruction. Therefore, we cannot guarantee absolute protection against all threats and the use of our Website (including the provision of Personal Infromation for any reason) is at your sole risk.

The Website is not intended for minors under the age of 18 years, and we do not intend to Process Personal Information from anyone we know to be under 18 years. This Notice is intended to comply with Applicable Laws in the jurisdictions in which Gilat operate or where Data Subject are protected by such Applicable Laws. Unless otherwise required by Applicable Laws, this Notice shall be governed by and construed in accordance with the laws of the State of Israel, excluding its choice of law principals. Disputes arising in connection with this Policy shall be subject to the exclusive jurisdiction of the competent courts in Tel Aviv-Jaffa, Israel

The new Policywill be effective as of the date it was last updated, as indicated below. If we make material changes to the Notice that significantly change your rights or the way we Process your Personal Information, we will notify you by posting a conspicuous notice on our Website or by contacting you directly. Where legally required and feasible, we will seek your renewed consent before implementing these changes.
